⚠️ Important Notice: Trading binary options and derivative financial instruments involves substantial risk of loss. Please read this Risk Disclosure carefully and in full before registering an account or placing any trade on GoldVest.
1 General Provisions
1.1Before registering on the GoldVest platform, all clients and prospective clients are required to read and understand this Risk Disclosure agreement in its entirety.
1.2By registering an account on GoldVest and using the trading platform, the client confirms that they have fully read, understood, and agreed to all terms contained in this Risk Disclosure.
1.3This Risk Disclosure is an integral part of the GoldVest Service Agreement and is binding on all registered clients.
1.4Acceptance of the GoldVest Service Agreement simultaneously constitutes acceptance of this Risk Disclosure.
1.5The risks described in this document do not represent an exhaustive list. Financial markets are dynamic and unpredictable — additional risks may arise that are not specifically listed here.
1.6This Risk Disclosure is provided for informational and guidance purposes. It does not constitute financial, legal, or investment advice.
2 Purpose of This Disclosure
GoldVest provides this Risk Disclosure to:
- Inform clients as fully as possible about the risks associated with trading in financial markets
- Warn clients about the specific risks of trading derivative financial instruments
- Help clients understand the possibility of sustaining losses as a result of trading activity
GoldVest recommends that before conducting any trading operation, clients carefully evaluate the potential risks against their personal financial goals and capabilities.
This disclosure is not intended to discourage clients from trading. Rather, it is designed to help clients make informed, responsible decisions and develop appropriate risk management strategies.
Recommendation: Only trade with funds you can afford to lose. Never use money intended for essential living expenses or emergency savings for trading purposes.
3 Trading Risks
The following risks are directly associated with the process of trading on financial markets:
Market Instability
Financial markets are inherently unpredictable. Economic events, geopolitical developments, and sudden news can cause rapid and significant price movements. When such events occur near market open or close, the price of an asset may differ dramatically from the previous closing price. This can result in both substantial profits and significant losses.
Market Volatility
All markets experience periods of volatility. Higher volatility means faster and larger price movements. While this creates opportunities for profit, it also increases the risk of loss. Highly volatile assets carry a greater risk of capital loss than stable, lower-volatility assets.
Asset Liquidity
The value of any asset is influenced by supply and demand, market sentiment, economic data, and political events. Liquidity conditions can change rapidly. Under low-liquidity conditions, it may not be possible to close a position at a favorable price, leading to potential losses.
Request Processing Under Unstable Conditions
During periods of market instability, the time required to process client requests may increase. Only one request at a time can be held in the queue for a given client — any duplicate requests will be automatically rejected by the system.
Derivative Instruments
Binary options are derivative instruments — their value is derived from an underlying asset such as a currency pair, cryptocurrency, or commodity. The client acknowledges that the price of the derivative is linked to, but may differ from, the underlying asset's live market price.
Risk Warning: Trading binary options can result in the total loss of the amount invested in a single trade. You should never invest more in a single trade than you are prepared to lose entirely.
4 Non-Trading Risks
In addition to market-related risks, clients should be aware of the following operational and technical risks:
4.1 Technical & Connectivity Risks
Internet & Power Failures
Interruptions to the client's internet connection, power supply, or device may prevent access to the trading platform. GoldVest is not responsible for losses resulting from such failures on the client's end.
Software & Equipment Issues
Malfunctions in the client's software, browser, or device hardware may cause delayed or failed requests. The client assumes full responsibility for maintaining functional equipment and a stable connection.
Third-Party Service Failures
Actions or failures by third-party providers — including internet service providers, payment processors, or telecommunications companies — may impact platform availability. GoldVest is not liable for disruptions caused by such parties.
Platform Access Interruptions
The client acknowledges that due to technical issues including (but not limited to) software errors, hardware failures, cyberattacks, or complete internet outages, access to the trading terminal or platform server may be temporarily unavailable. GoldVest is not liable for any losses — including missed profits — arising from such events.
4.2 Force Majeure
The client accepts the risk of loss arising from force majeure events — extraordinary circumstances beyond anyone's reasonable control — including:
- Natural disasters (floods, earthquakes, fires, etc.)
- Wars, military operations, terrorist attacks, or civil unrest
- Strikes, political instability, or government actions
- Pandemics or large-scale public health emergencies
- Market closures, exchange suspensions, or regulatory interventions
- Extreme currency movements or market disruptions
4.3Closing the browser window or app does not cancel a request that has already been submitted to the GoldVest server. The client must confirm the cancellation through the platform if they wish to withdraw a request (where permitted).
4.4The client is solely responsible for all confidential information related to their account, including login credentials. Any financial losses resulting from unauthorized third-party access to the client's account are the client's responsibility.
4.5GoldVest is not responsible for unauthorized access to the client's personal data, emails, or account credentials that may occur as a result of data transmission over the internet or other communication channels.
6 Client Responsibilities
6.1The client is solely responsible for all trading decisions made on the GoldVest platform, regardless of any information or market conditions provided by the Company.
6.2The client selects their own trading strategy and is responsible for its outcomes. GoldVest does not endorse or validate any particular trading approach.
6.3The client is responsible for understanding and complying with all applicable laws and regulations in their country of residence regarding the use of derivative financial instruments. Any legislative restrictions that prevent the client from trading are the client's responsibility.
6.4The client is responsible for paying all applicable taxes on trading profits. GoldVest does not provide tax advice and is not liable for any tax obligations arising from the client's trading activity.
6.5All financial losses associated with delayed or undelivered messages from the Company — resulting from connectivity issues on the client's side — are the client's responsibility.
6.6The client assumes all risks associated with submitting duplicate requests. GoldVest cannot guarantee the outcome of multiple simultaneous requests.
6.7If funds deposited or withdrawn pass through third-party payment providers, GoldVest is not liable for the actions or failures of those providers.
Remember: Trading in derivative financial instruments is speculative in nature. It is suitable only for individuals who fully understand the risks involved and who can bear the financial consequences of potential losses.
7 Company Limitations of Liability
7.1GoldVest is not liable for any direct, indirect, or consequential losses — including lost profits — arising from trading activity on the platform.
7.2GoldVest does not guarantee that trading on the platform will be profitable or free from loss.
7.3GoldVest is not liable for losses arising from the client's reliance on market information, signals, or analysis provided by the Company or third parties.
7.4GoldVest is not liable for platform downtime, technical failures, or interruptions to the service — regardless of their cause — unless such failures are solely the result of gross negligence by the Company.
7.5GoldVest does not guarantee that the trading of derivative financial instruments is, or will remain, exempt from taxation in the client's jurisdiction.
7.6Past performance of any asset, signal, or trading strategy does not guarantee or indicate future results.
Final Note: By trading on GoldVest, the client confirms they are fully aware of the risks involved, have considered them carefully in light of their financial situation, and have decided to proceed voluntarily. If you have any doubts, we strongly recommend seeking independent financial advice before trading.
